These Terms and Conditions ("Terms") govern your access to and use of the website pichup.org ("Website") and the purchase or exchange of digital products ("Question Banks") offered by the sole proprietor operating under the brand name Pichup ("we", "us", "our"). By accessing this Website or purchasing/exchanging any Question Bank, you ("Buyer", "User", "you") agree to be bound by these Terms in their entirety. If you do not agree, do not use this Website.

1. Nature of Products

  1. Question Banks are digital informational products containing curated collections of interview questions. They are sold strictly "as-is" and "as-available" at the time of purchase.
  2. Question Banks are curated from candidate networks — individuals who have gone through interview processes at the respective companies and reported the questions they encountered. Content is compiled, structured, and verified across multiple independent candidate reports.
  3. We do not claim any affiliation with, endorsement by, partnership with, or authorization from any company whose name appears on this Website. Company names and trademarks are the property of their respective owners and are used solely for identification purposes to indicate which company's interview process the questions relate to.
  4. Question Banks are independent compilations of reported interview experiences. They are not, and do not purport to be, official company materials, confidential documents, proprietary content, or materials obtained in violation of any contractual obligation.
  5. The content of Question Banks may be outdated, incomplete, inaccurate, or no longer reflective of the company's current interview process. Interview processes, questions, formats, and evaluation criteria change frequently and without notice. We make no representation that any question will appear in any future interview.
  6. The value of Question Banks lies in their curation, structure, and cross-verification — not in any claim of exclusivity or official provenance.

1A. Content Sourcing

  1. All content is sourced from voluntary contributions by candidates who share their interview experiences with our network.
  2. Contributors represent that they are sharing their own recollections of interview experiences and that doing so does not violate any agreement they have with any employer or prospective employer.
  3. We do not solicit, encourage, or facilitate the breach of any non-disclosure agreement, confidentiality obligation, or employment agreement.
  4. If any content owner or rights holder believes that any material on this Website infringes their rights, they may submit a takedown request as described in our DMCA/Takedown Policy below.

2. No Guarantees — Assumption of Risk

  1. We make absolutely no guarantee, representation, or warranty that any question contained in a Question Bank will appear in any actual interview.
  2. We make no guarantee that using a Question Bank will result in a job offer, interview advancement, positive evaluation, or any specific outcome.
  3. We make no guarantee regarding the accuracy, completeness, timeliness, relevance, or quality of any Question Bank content.
  4. You acknowledge and agree that you purchase or trade for Question Banks entirely at your own risk. The decision to use this material in your interview preparation is yours alone.
  5. You understand that interview questions are inherently perishable information — their value decreases over time as companies update their processes.
  6. We are not liable for any interview outcome, employment decision, lost opportunity, emotional distress, financial loss, or any other direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use any Question Bank.

3. Not Fraud — Informed Purchase

  1. By completing a purchase, you acknowledge that you have read and understood these Terms, including all disclaimers and limitations.
  2. You acknowledge that this is a voluntary, informed transaction for digital informational content of known uncertain value.
  3. You acknowledge that you are not purchasing guaranteed interview outcomes, insider information, or confidential company materials. You are purchasing a curated collection of reported interview questions from past candidates.
  4. Filing a false or frivolous fraud claim, chargeback, or dispute after purchasing a Question Bank with full knowledge of these Terms may constitute abuse of the dispute process and we reserve the right to pursue appropriate remedies.

4. Digital Product — No Refunds

  1. All Question Banks are non-refundable digital products. Once a download link has been delivered to your email, the sale is final.
  2. Due to the digital nature of the product, it is impossible to verify non-use or return of the content after delivery. Therefore, no refunds, returns, exchanges, or credits will be issued under any circumstance, including but not limited to:
    • Dissatisfaction with the content, quality, or quantity of questions
    • Questions not appearing in your actual interview
    • Failure to receive a job offer
    • Inability to download within the link expiry window (contact us for a new link)
    • Discovering the content is already known to you
    • Changes to the company's interview process after your purchase
  3. This no-refund policy is consistent with standard industry practice for digital informational products and is permitted under the Consumer Protection (E-Commerce) Rules, 2020 for digital goods that have been accessed or delivered.

5. Licensing and Usage

  1. Each purchase grants you a personal, non-transferable, non-exclusive license to use the Question Bank for your own interview preparation.
  2. You may not redistribute, resell, share, publish, upload to any website, forward the download link to others, or otherwise make the content available to any third party.
  3. All delivered PDFs are digitally watermarked with your name and email address. Any unauthorized distribution will be traceable to your account.
  4. Violation of these licensing terms may result in legal action and pursuit of damages.

6. Trade/Exchange Program

  1. The trade program allows you to submit a Question Bank you possess in exchange for another, subject to our tier-based eligibility system.
  2. All submissions are manually reviewed. We reserve the right to reject any submission for any reason, including but not limited to: low quality, duplicate content, irrelevant questions, incorrect company attribution, or suspected pirated material.
  3. Submitting a Question Bank does not guarantee approval or entitle you to receive a bank in return.
  4. By submitting a Question Bank, you represent that you have the right to share that content and that it does not infringe any third-party rights.

7. Intellectual Property

  1. The compilation, selection, arrangement, structure, and presentation of Question Banks is our original work and is protected by applicable intellectual property laws as a compiled work.
  2. Individual interview questions are recalled by candidates as factual accounts of their interview experiences. We do not claim ownership of the underlying questions themselves, nor do we claim that these questions originate from any proprietary source.
  3. The reporting and sharing of interview experiences is protected as factual information sharing. Just as review platforms publish user-reported experiences, our Question Banks compile candidate-reported interview questions.
  4. The Website design, branding, and source code are our property.

7A. DMCA / Takedown Policy

  1. We respect intellectual property rights. If you are a rights holder and believe that any content on this Website infringes your copyright, trade secret, or other proprietary right, you may submit a takedown request.
  2. Your takedown notice must include:
    • Identification of the copyrighted work or proprietary material claimed to be infringed
    • Identification of the material on our Website that you claim is infringing, with sufficient detail to locate it
    • Your contact information (name, address, email, phone number)
    • A statement that you have a good faith belief that the use is not authorized by the rights owner, its agent, or the law
    • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights owner or authorized to act on their behalf
    • Your physical or electronic signature
  3. Submit takedown requests via our contact page.
  4. Upon receipt of a valid takedown notice, we will promptly investigate and, if appropriate, remove or disable access to the identified content.
  5. We reserve the right to request additional information or verification before acting on any notice.

8. Acceptable Use

You agree not to:

  1. Use the Website or any Question Bank for any purpose that is unlawful or prohibited by these Terms.
  2. Attempt to reverse-engineer, decompile, scrape, crawl, or extract data from the Website by automated means.
  3. Interfere with, disrupt, or place an undue burden on the Website or its infrastructure.
  4. Circumvent, disable, or otherwise interfere with security features of the Website, including download limits, watermarking, or access controls.
  5. Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  6. Use any Question Bank to create a competing product or service.
  7. Share, redistribute, resell, or sublicense any Question Bank or download link.
  8. Remove, alter, or obscure any watermark, copyright notice, or proprietary marking from any Question Bank.

8A. User-Submitted Content (Trade Program)

  1. License grant: By submitting a Question Bank through our trade program, you grant Pichup a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, distribute, and display the submitted content for the purpose of operating the trade program and the Website.
  2. Representations: By submitting content, you represent and warrant that:
    • You own or have the necessary rights and permissions to share the content.
    • The content consists of your own recollections and notes from your personal interview experiences.
    • Sharing the content does not violate any non-disclosure agreement, confidentiality obligation, employment agreement, or other contractual restriction to which you are a party.
    • The content does not infringe the intellectual property rights of any third party.
    • The content is not defamatory, obscene, or otherwise unlawful.
  3. Indemnification by contributors: You agree to indemnify and hold harmless Pichup from any claims, damages, or expenses arising from your breach of the representations above. If a third party claims that your submitted content infringes their rights, you bear sole responsibility.
  4. No obligation: Pichup is under no obligation to accept, use, host, or distribute any submitted content. We may reject, remove, or modify any submission at our sole discretion.
  5. No compensation: Other than the exchange of a Question Bank as described on the Website, no monetary or other compensation is owed to you for your submission.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ALL QUESTION BANKS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that: (a) the Website will be uninterrupted, secure, or error-free; (b) any Question Bank will meet your expectations or requirements; (c) any information in any Question Bank is accurate or up-to-date; (d) any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR OPPORTUNITIES, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE WEBSITE OR ANY QUESTION BANK, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR ANY QUESTION BANK SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC QUESTION BANK GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pichup, its owner, and its affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Website or any Question Bank; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any unauthorized distribution of Question Bank content.

12. Chargebacks and Disputes

  1. If you initiate a chargeback or payment dispute after receiving the download link, we reserve the right to revoke access, ban your email from future purchases, and pursue the disputed amount plus applicable fees.
  2. We will provide transaction records, delivery confirmation, and these Terms to the payment processor in response to any dispute.
  3. We encourage you to contact us directly at our contact page before initiating any dispute with your bank or payment provider.

13. Privacy

Your use of this Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Account Termination and Banning

  1. We reserve the right to refuse service, terminate access, and ban any user at our sole discretion, without prior notice, for any reason, including but not limited to:
    • Violation of these Terms
    • Redistribution of Question Bank content
    • Filing a fraudulent chargeback
    • Submitting fraudulent trade submissions
    • Attempting to circumvent security measures
    • Any conduct we deem harmful to the Website or other users
  2. Termination does not entitle you to any refund for previously purchased Question Banks.
  3. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

15. Governing Law and Jurisdiction

  1. These Terms are governed by and construed in accordance with the laws of India.
  2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in the city where the proprietor's registered business address is located.
  3. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Dispute Resolution

  1. Informal resolution first: Before initiating any formal legal proceeding, you agree to first contact us via our contact page and attempt to resolve the dispute informally for at least 30 days.
  2. Arbitration: If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The arbitration shall be conducted by a sole arbitrator mutually agreed upon by the parties, and the seat of arbitration shall be the city of the proprietor's registered business address.
  3. Costs: Each party shall bear its own costs of arbitration. The arbitrator may, at their discretion, award costs to the prevailing party.
  4. Injunctive relief: Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

17. Class Action Waiver

YOU AGREE THAT ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE WEBSITE OR QUESTION BANKS WILL BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. You waive any right to participate in a class action or class-wide arbitration. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.

18. Entire Agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Pichup regarding the use of the Website and the purchase or exchange of Question Banks. These Terms supersede any prior agreements, communications, or understandings, whether written or oral.

19. Modifications

We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting on this page. Your continued use of the Website after changes constitutes acceptance of the modified Terms. We recommend reviewing this page periodically. For material changes, we will update the "Last updated" date at the top of this page.

20. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

21. Waiver

The failure of Pichup to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.
